If I have the TOP variant Assistance insurance, will the Emergency Centre supply fuel (necessary to reach the nearest gas station), will it cover the costs of fuel and will it deliver and pay for spare parts necessary to continue the trip?
The Emergency Centre will deliver necessary fuel to reach the nearest gas station but you need to cover the cost of fuel yourself. The Emergency Centre will deliver spare parts necessary to continue the trip but you need to pay for such spare parts yourself.
Does Assistance insurance cover the cost of towing in case of an insurance event abroad?
Yes, in BAZA variant up to EUR 100 and in TOP variant up to EUR 2,500.
How much is the TOP variant Assistance insurance?

If I get a puncture, will my Assistance services (TOP variant) deliver a spare wheel?
No, they will not deliver a spare wheel but they may change the wheel for you.

Both, OC and AC.

What does “All Risks Motor Hull Insurance” mean?
It means that the motor hull insurance covers all risks except for risks listed in exclusions of liability.
What does a “constant sum insured” mean?
When you buy the option of constant sum insured while signing an agreement, your sum insured of motor hull insurance will remain constant for the next 12 months.

Must a car purchaser terminate their insurance contract if he/she bought a car insured in Compensa and Compensa was informed about the sales of the car by the previous owner?
The purchaser of a car does not have to terminate an insurance agreement and may continue to be covered by the policy. To do this, he/she has to go to Compensa's Branch Office and sign an annex to the insurance agreement. Full list of Branch Offices is presented here
How should a car owner inform Compensa about selling his/her vehicle?
Information on selling car shall be filed in written form, with handwritten signature of a car seller, with a copy of the sales agreement or a tax invoice confirming the sale, within 30 days from the car sale. Documents can be sent to the headquarters by mail, e-mail (in attachment), fax or can be delivered to the nearest Branch Office of Compensa.

Must a car owner inform Compensa about selling his/her vehicle?
Yes, you need to inform Compensa about this transaction.
How to terminate a third party liability insurance agreement (OC) or what to do in order to continue the OC policy held by the previous car owner?
If a new owner does not want to continue the previous owner's third party liability insurance agreement (OC), he/she may terminate the policy in writing within 30 days from the purchase date in the Settlement Centre or Compensa's Branch Office (i.e. fill in a termination form and show the sales agreement). If a purchaser wants to continue the third party liability insurance agreement (OC), he/she may contact the nearest Branch Office of Compensa and sign an annex to the agreement, providing Compensa with his/her personal data and vehicle data.
Is a new owner entitled to premium reductions granted to the previous owner?
No. According to act from the 22nd of May 2003 on obligatory insurance, UFG and PBUK, insurer should recalculate the premium regarding to coverage offered, collectible reductions or advancements within the tariff.
Who has to pay overdue premium when a car is sold?
A new owner should check if premiums have been paid by a seller. If the seller failed to pay the premium, both the seller and the purchaser shall be jointly liable for the payment of overdue premiums until the new owner nofities the Company about the purchase. If the purchaser already informed the company the purchase, as from the moment of notification the purchaser is liable for the payment of premiums. The seller is obliged to pay overdue premiums from the moment the purchaser notifies the insurance company about the purchase.
What is the minimum insurance period for third party liability insurance (OC)?

Is motor third party liability insurance (OC) in force abroad?
The third party liability insurance (OC) is valid in the majority of European counties. If you travel abroad, check if your insurance is valid in the country you travel to. What is the territorial scope in BAZA and MOC variants of motor hull insurance (AC)?
In MOC variant the insurance covers losses that occur in the territory of Poland. Only after an additional premium is paid, the insurance may cover losses that occur in the territory of the European Union and other countries listed in the General Terms and Conditions of insurance. In BAZA variant the insurance covers losses that occur in the territory of Poland and losses that occur in the territory of the European Union and other countries listed in the General Terms and Conditions of insurance, without an additional premium.

Who pays the costs of a parking place after a road accident?
If it is a claim under a third party liability policy (OC) of a driver at fault, it is the driver's at fault insurance company that covers the costs of a parking place from the date of accident till the next day after an inspection of the vehicle.
How much time does an insurer have to pay a benefit?
30 days from the date of reporting a claim if all documents from both the aggrieved party and the driver at fault have been delivered in time; 90 days in case of insurance events that occur abroad, and 30 days in case of indisputable personal claims.
How can I apply for premium return?
You should submit a written request (personally or by mail) to the Settlement Centre (according to your place of residence) for a return of overpaid premiums.
Does a car co-owner also lose the right for premium discounts after a disbursement of a benefit?
Both owner and co-owner lose their premium discounts.
What is the upper limit of claims that are not covered by Compensa under third party liability policy (OC)?
All claims, regardless of their amount, are covered under third party liability policy (OC). The upper limit is the guaranteed sum that amounts to EUR 5,000,000 for personal injuries and to EUR 1,000,000 in case of damage to property.
Is there an upper liability limit of Compensa in case of claims under third party liability policy (OC)?
Yes. It is the guaranteed sum that amounts to EUR 5,000,000 for personal injuries and to EUR 1,000,000 in case of damage to property.
What should I do if driver at fault has no third party liability policy (OC)?
The aggrieved party should report the claim to any insurance company that then sends the claim to the Insurance Guarantee Fund. The Insurance Guarantee Fund is responsible for paying out claims under mandatory insurance that take place on the territory of the Republic of Poland:
  • in case of personal injuries, if identity of an owner or driver of a motor car could not be determined,
  • in case of property damage, if a perpetrator is known but has no mandatory third party liability policy (OC),
  • in case of personal injuries and property damage, if identity of an owner or driver of a motor car was not determined and a perpetrator had no mandatory third party liability policy (OC),
  • if a farmer, a person from farmer's household or another person working on the farm caused personal injuries or damage to property and the farmer has no mandatory third party liability policy (OC).
Under which insurance policy (of a trailer or a tractor) shoulc a claim be reported if a trailer disconnects from a moving tractor and crashes into another vehicle?
Under the insurance of a tractor.
Who shall be responsible for a loss that occurs 2 days after entering into a car purchase agreement?The new or the old owner?

Does the third party liability policy (OC) include damage caused intentionally or in result of gross negligence?
Yes, it does.
May the insurance company provide access to claim files to a customer?

May the insurance company claim a return of disbursed benefit against a driver, if he/she had left the place of an accident?

Where should I report a claim if the Police state that both parties are guilty of an accident?
Participants in an accident should report a claim to an insurance company of the other party, which means that the person insured by Compensa should report a claim to the insurance company of the other participant and the other participant – to Compensa.
Does a claim under the third party liability policy (OC) include costs of an additional technical examination as well?
Yes.
In what circumstances is it an obligation to call the Police in case of a road accident?
The Police should be notified if:
  • there are injured persons,
  • a driver left the place of an accident,
  • a participant in an accident is under the influence of alcohol or drugs,
  • when the parties cannot reach an agreement about who is responsible for the accident,
  • if a foreigner participates in the collision,
  • if any of the participants in the accident doesn't have a valid third party liability policy (OC).
What should be done if a vehicle drives into a hole in the road and the insured has no motor hull policy (AC)?
You should call the Police and then contact the road administrator and ask for the series and number of their third party liability policy. A claim shall be reported to the issuance company of the administrator.
If cars belonging to the same person or a company were the only participants in an accident, is it possible to claim a compensation under the third party liability policy (OC)?
No.
Is an insurance contract terminated after a loss is qualified as a total loss and a respective benefit is paid out?
Yes.
May a car be insured under motor hull insurance (AC) in case of a loss qualified as a total loss, after it has been repaired?
Yes, but only upon consent of the insurance company. If a driver was driving above the speed limit at the moment of accident, may the insurance company reduce the amount of benefit disbursed under motor hull policy (AC)?
If so, by how much?
Yes. If the speed limit was exceeded by 30 km/h and more, a benefit disbursed under motor hull policy (AC) is reduced by 25%.
May a claim under property thirf party liability insurance be reported if a loss occurs in another place than the flat insured?
Yes.
If the Insured has a few vehicles and one of them participated in a road accident in result of which a claim under motor hull policy (AC) was disbursed, is the right for premium reduction lost in relation to such a vehicle only or to all vehicles?
To all vehicles.

No.
Does Assistance insurance (TOP variant) ensure that I will be provided with necessary fuel/spare parts on the way and does the insurance cover the costs of fuel/spare parts?
Assistance insurance (TOP variant) ensures delivery of necessary fuel to reach the nearest gas station and delivery of spare parts necessary to repair a car. The cost of both the fuel and spare parts is covered by the insured, who pays them directly to the road assistance service. The Emergency Centre guarantees a free-of-charge delivery of fuel/spare parts to the place specified by the Insured.
If an insurance event occurs abroad and a vehicle is covered with the Assistance Insurance, does the Emergency Centre ensure car transportation?
Yes, in BAZA variant up to EUR 100 and in TOP variant up to EUR 2,500.
How much time do I have for reporting a claim under third party liability insurance (OC), personal civil liability insurance, motor hull insurance (AC) and accident insurance (NNW)?
  • OC – 3 years,
  • personal thrid party liability – 10 years,
  • AC (damage) – 5 business days in case of an insurance event on the territory of Poland,
  • AC (theft) – 2 business days in case of an insurance event on the territory of Poland,
  • AC (damage, in case of an insurance event outside the territory of Poland) – 5 business days after crossing the border, in case of an insurance event abroad and 3 business days after crossing the border, if Compensa's representative abroad was asked to help,
  • NNW – immediately but not later than 24 months from the date of the loss.
What happens to a disbursement of a claim, if a car was driven by a person that was not covered with the policy at the moment of accident (e.g. under 25 years of age)?
An additional deductible in the amount of PLN 1,500 is deducted.
If I have a flat tyre, does my Assistance insurance (TOP variant) cover the costs of arranging, supplying and purchase of a spare wheel?
No. A representative of the Emergency Centre may only replace a flat tyre with the spare tyre in which the insured vehicle is equipped. Costs of a return trip and the replacement of wheels are covered by the Emergency Centre.
What is the consumption of sum insured?
It is an exhaustion of the sum insured in result of disbursement of benefits for claims reported in the period of insurance.
Where should I go in order to find out the name of a loss adjuster who handles my claim?
The name of a loss adjuster and his/her contact data have been provided in the letter confirming that Compensa received a notification of claim. If for any reason it is not possible to determine the name of the loss adjuster, please call our hotline at 801 120 000.
Do I have to notify a building manager or managing company about a loss that occurred in the immovable property where I live?
If you notify a loss under your own policy, it is not necessary to notify a building management company. You should notify a building management company if a loss occurred in the common areas that belong to the building management company.
How are losses reported in case of property insurance – claims under accident insurance (NNW)?
You should send a claim form together with medical documents.
What should I do if I want to claim a reimbursement of medical treatment costs under individual life insurance?

May I hire an independent expert for an inspection if I do not accept the valuation results?
Yes.
When do I lose a right for premium discount in case of a loss?
After a benefit is disbursed.
May a loss be settled with a car repair shop without cash?

No, it is strictly forbidden.
What is the difference between individual and group life insurance?
Individual life insurance is related to one person only while group insurance refers to employees of companies. They are concluded on different terms and conditions.

How to terminate a third party liability insurance policy (OC)?
A third party liability policy (OC) agreement may be terminated not later than one day before the end of the agreement period. Policy must be terminated in writing. If you want to terminate a policy, please contact our Hotline: 801 120 000.

How to terminate a third party liability insurance agreement (OC) or what to do in order to continue a third party liability insurance agreement (OC) of the previous vehicle owner when the car is sold?
If a purchaser does not want to continue the previous owner's third party liability insurance agreement (OC), he/she may terminate in within 30 days in writing in the Settlement Centre or Compensa's Branch Office (fill in a termination form and present the car's sales agreement). If a purchaser wants to continue the third party liability insurance agreement (OC), he/she should contact the nearest Branch Office and sign an annex to the agreement, providing Compensa with his/her personal data and a new registration plate numbers of the car.
When is OC premium returned to the insured?
The premium may be returned providing that:
  • you sold a car and the new owner terminated third party liability insurance policy (OC) within 30 days (as from the date of the sales agreement). You have to submit a written request (personally or by mail) to the Settlement Centre (competent for the place of insurance) for a repayment of the overpaid premium,
  • a car has been scrapped and deleted from car register,
  • damage to a vehicle is considered to be a total loss and the vehicle is deleted from car register,
  • a car is stolen, after completion of Police investigation (it is discontinued within 30 days) and a vehicle is deleted from car register.
May I insure a car for 1 month only?
Yes, if:
  • a vehicle is registered temporarily,
  • a vehicle is registered abroad,
  • it is a historical vehicle.
Is it only the owner who loses the right to premium discount after a disbursement of a benefit, or a co-owner as well?
The right to premium dicsount is lost by both the owner and the co-owner.
Whose right to premium discount is taken into account – of the owner's or co-owner's of a vehicle?
Always the right to higher discount is taken into account.
May a purchaser use premium discounts to which the previous owner was entitled?
No. According to the act from the 22nd of May 2003 on obligatory insurance, UFG and PBUK, insurer should recalculate the premium regarding to coverage offered, collectible reductions or advancements within the tariff.

A car purchaser should check if premiums have been paid by the previous owner. If he/she failed to pay the premium, the previous and current owner shall be jointly liable for payment of overdue premiums until the new owner notifies the Company about the purchase agreement. If the new owner has already informed the Company about the purchase, as from the moment of notification the purchaser is liable for payment of premiums. Overdue premiums are collected by the Company from the seller (if they were not paid until the Company is notified by the new owner about the purchase).

The sum insured amounts to PLN 25,000.
If I am late with payment of a premium is the motor hull insurance agreement (AC) terminated automatically?
If a Customer is late with payment of a premium, Compensa sends a reminder to a Customer. If a Customer fails to pay the premium after the reminder, motor hull insurance agreement (AC) is terminated automatically.
If I have Assistance insurance do I have the right to be towed in case of an insurance event abroad?
Yes, in BAZA variant up to EUR 100 and in TOP variant up to EUR 2,500.
What is a deductible and how much is it?
A deductible is an amount or a percentage of the sum insured determined in the insurance agreement that is treated as the policyholder's share in a claim, and the benefit amount is reduced by this share. The deductible amounts to:
  • in AC BAZA variant – PLN 700 (standard) or PLN 2,000 (higher),
  • in AC MOC – 2% of sum insured but not less than PLN 700.

What is the territorial scope in BAZA and MOC variants of motor hull insurance (AC)?
In MOC variant the insurance covers losses that occur on the territory of Poland. Only after an additional premium is paid, the insurance may cover losses that occur on the territory of the European Union and other countries listed in the General Terms and Conditions of insurance. In BAZA variant the insurance covers losses that occur on the territory of Poland and losses that occur on the territory of the European Union and other countries listed in the General Terms and Conditions of insurance (without an additional premium).

Vehicle up to 10 years of age (except for policy renewal).
What is meant by basic equipment of a vehicle?
Basic equipment consists of devices and equipment permanently fixed in a vehicle in its production process or a process of preparation of a brand new car for sales.
What is meant by additional equipment of a vehicle?
Additional equipment consists of devices and equipment permanently fixed in a vehicle, but other than the basic equipment and the disassembly of which requires tools and mechanical devices. Examples of additional equipment:
  • car audio equipment,
  • audiovisual equipment,
  • CD player,
  • telephone and radio communication equipment,
  • navigation devices, e.g. GPS,
  • loud-speaking equipment,
  • external rack,
  • taximeters, towing hook, spoilers, covers and advertising stickers.
What does “All Risks Motor Hull Insurance” mean?
It means that the motor hull insurance covers all risks expect risks listed in exclusions of liability.
Is it possible to exclude the risk of theft from the motor hull insurance (AC)? And if so, would I pay less for the policy?
Yes, it is possible to exclude the risk of theft. You decide on the exclusion of theft risk while signing the policy. With an exclusion of theft the premium will be 20% lower.
What does a “constant sum insured” mean?
A constant sum insured means that when you declare to buy this option (while signing the policy), your sum insured will remain constant for the next 12 months.
What is the maximum age of vehicle for which I can buy a constant sum insured option?

What conditions should be fulfilled to use the option of repairs with alternative spare parts?
Requirement for repairs with alternative spare parts:
  • appropriate car make, that is Fiat, Ford, Opel, Peugeot, Renault, Skoda, Toyota,
  • period of usage longer than 2 years,
  • vehicle not covered with manufacturer's guarantee,
  • vehicle repair in Compensa's partner repair shops.
What is the premium loading (in %) in case of new motor hull insurance if a vehicle was produced in the US, Canada or Mexico?

Will I lose the right for premium discount under motor hull insurance (AC) in case of a recourse claim?
If a recourse claim is fully satisfied by Compensa, the right of premium reduction will be returned to you if you were deprived of it earlier.
